1. Scope of Application
- 1.1 These Terms of Service (hereinafter "Terms") apply to all contracts concluded between a consumer or a trader (hereinafter "Customer") and OSTMORAD (hereinafter "Seller") relating to all goods and/or services presented in the Seller's online shop.
- 1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. A trader is a natural or legal person or a legal partnership acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2. Conclusion of the Contract
- 2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but merely serve to invite the Customer to submit a binding offer.
- 2.2 The Customer may submit the offer via the online order form integrated into the Seller's online shop. By clicking the button that concludes the order process, the Customer submits a legally binding contractual offer in relation to the goods contained in the shopping cart.
- 2.3 The Seller may accept the Customer's offer within five days by sending a written order confirmation or an order confirmation in text form (via email), or by delivering the ordered goods. If the Seller does not accept the Customer's offer within this period, this shall be deemed a rejection of the offer.
- 2.4 Order processing and communication take place primarily via email and automated systems. The Customer must ensure that the email address provided during checkout is accurate and functional.
3. Right of Withdrawal & RMA Return Framework
- 3.1 Statutory Right: Consumers residing within the European Union/EEA are entitled to a statutory right of withdrawal within a 14-day period from the day on which the Customer acquires physical possession of the goods.
- 3.2 Formal RMA Requirement: To initiate a return, the Customer must formally contact our support team at info@ostmorad.com to obtain a Return Merchandise Authorization (RMA) and the specific assigned warehouse destination.

3.3 Designated Return Routing:
- European Regional Orders: Items fulfilled and dispatched from our European Fulfillment Center must be returned directly to our Poland logistics hub.
- International Orders: Items fulfilled and dispatched from our international Asian network must be processed through our assigned Asian logistics hub.
- Please note: Returns sent without a valid RMA authorization may not be processed. Always contact us first at info@ostmorad.com before shipping any return. Do not send items to our US corporate registry address or carrier addresses on the shipping label.

3.4 Return Shipping Fees:
- In the event of a voluntary return based on customer preference (no-reason return), the Customer shall bear the direct cost of international or regional return shipping.
- If the return is due to a verifiable product defect, transport damage, or sorting error attributable to OSTMORAD, we shall bear the cost of return shipping or provide a prepaid return label.
- 3.5 Condition of Returns: Returned items must be brand new, unused, uninstalled, free of mechanical markings, and enclosed securely in their original packaging.
4. Prices, Shipping, and Payment Conditions

4.1 Net Pricing & Tax Disclaimer: Unless explicitly stated otherwise, all prices indicated in our shop are net prices and do not include VAT. All orders are shipped under Delivered Duty Paid (DDP) terms. All applicable customs duties, import taxes, and carrier handling fees are prepaid by OSTMORAD regardless of the originating fulfillment hub. The Customer will not be charged any additional fees upon delivery.
- EU-to-EU Warehousing: Deliveries processed locally out of our Polish facility to EU destinations do not incur import customs tariffs.
- International Cross-Border: For items dispatched via our international network, all customs clearance and import duties are handled and prepaid by OSTMORAD on behalf of the Customer.
- 4.2 Global Dual-Warehouse Fulfillment: To minimize transit times, OSTMORAD utilizes a dual-hub network: our primary international logistics center in Asia and our European Fulfillment Center situated at: C/O Aurora Logistics, HiPark, Kilińskiego 74A, Gate 19, 69-110 Rzepin, Województwo lubuskie, Poland. The Seller reserves the right to determine the originating fulfillment hub based on local stock availability and target destination requirements.
- 4.3 No Self-Collection: Due to strict automated warehouse safety and logistical constraints, physical pickup or self-collection by the Customer is unavailable. Deliveries are executed solely via registered parcel couriers.
- 4.4 Exclusivity of New Goods: OSTMORAD deals exclusively in brand-new, factory-fresh motorcycle and moped components. We do not retail second-hand merchandise, nor do we provide mail-in mechanical repair or refurbishment services.
- 4.5 Customization Limits: We do not accept individual single-item bespoke manufacturing or personal product modifications through the standard online storefront. Custom requests are restricted exclusively to bulk commercial B2B orders via prior formal written contract.
5. Retention of Title The Seller retains absolute legal ownership of all delivered goods until the purchase price owed has been settled in full by the Customer.
6. Liability for Defects (Statutory Warranty)
- 6.1 Consumer Protection: For consumers, statutory liability regulations for product defects shall apply (a standard 2-year warranty period within the EU for defects present at delivery).
- 6.2 Trader Limitations: For commercial traders, the limitation period for defect claims on new goods is restricted to one year from the legal date of delivery. Statutory limitation periods regarding rights of recourse remain unaffected.
- 6.3 Transport Damage Notification: Customers are requested to immediately report obvious transport or outer packaging damage to the delivering courier agent and notify OSTMORAD support within 48 hours with photographic evidence. Failure to do so does not void your statutory rights but assists us in recovering claims against logistics underwriters.
7. User Comments, Feedback, and Submissions
- 7.1 Feedback Usage: If you send creative ideas, suggestions, proposals, designs, or other materials online or by email to our official address (info@ostmorad.com) (collectively, "Comments"), you grant OSTMORAD a non-exclusive right to use such feedback solely for the purpose of improving our products and services.
- 7.2 No Obligations: We are under no obligation to hold comments in confidence, pay financial royalties or compensation, or issue responses to unsolicited submissions.
8. Applicable Law & Dispute Resolution
- 8.1 Governing Law: The laws of the United States govern all contractual relations between the parties, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- 8.2 Consumer Carve-Out: For consumers residing within the European Union, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory protective provisions of the law of the State in which the consumer has their habitual residence.
- 8.3 Online Dispute Resolution (ODR): The European Commission provides an official platform for online dispute resolution, accessible at https://ec.europa.eu/consumers/odr. OSTMORAD is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
